The website www.byterry.com (the “Website”), operated by the company JIL – « By Terry », a French Société par actions simplifiée with a capital of 1 746 000 €, whose headquarters are located 24 rue Erlanger – 75016 Paris, registered at the PARIS RCS under number 410 318 968 (hereinafter, “BY TERRY”), contains sections allowing the users to upload photographs, videos and other types of information about themselves, including the “True Motion Shot” and the “Expert Community” sections (the “Sections”). These terms of use (the “Terms of Use”) apply to any user using a Section.

Users that upload posts in the Sections (hereinafter, the “Users”) hereby authorize BY TERRY to use the data and information included in the posts uploaded in the Sections (the “Posts”), including the image of the User, pictures, videos, caption, comments, location information and any information included by the User in its Post (the “User Content”).

We also offers an online consultation service which requires the collection and processing of your personal data in order to provide the service ordered, to confirm the appointment and send you all the necessary information concerning your appointment, to follow up on your consultation and send you a report of your consultation, to establish your customer profile and finally to send you offers that we believe may be of interest to you.The processing of your personal data is necessary for BY TERRY to fulfill the service of managing and delivering the order to you and we will keep your data for as long as you are an active customer.

If you have given us your data without opening an account / subscribing to the newsletter, we will keep your data for as long as reasonably required and for up to three years from the last contact with you to enable fulfillment of our contract with you and for future customer service.

Virtual Beauty Consultations

Personal data communicated when making your beauty appointment on this website or subsequently when using our service are processed by BY TERRY – Luxe, Art, Beauté LAB.

Personal data will be used to confirm your appointment, communicate important information concerning your appointment, provide the requested service and ensure the follow up after your consultation. Your personal data might also be used by our company to send you offers that might be of interest to you.

We, or authorised third parties who act on our behalf, will use your personal data to create and manage your personal account in order to give you a personalised and relevant experience at BY TERRY and make your future purchases easy and enjoyable. We will provide you with your order history, details around your orders and enable you to handle your account settings (including marketing preferences), save items in your shopping bag, and rate and review the products you've purchased from us. To provide you with relevant product recommendations, BY TERRY will process your data including, but not limited to, navigation, browsing and shopping history and product reviews, as well as the data you submitted to us. Should you purchase goods on the BY TERRY website, you may be sent an email requesting whether you would like to review the product you have purchased.

The processing of your personal data is based on your consent when you open your account with BY TERRY or Expert Club and we will keep your data for as long as we have your active account. You have the right to withdraw your consent from the processing of your personal data at any time by closing your account(s) with BY TERRY and/or Expert Club.

Competitions and promotions

We, or authorised third parties who act on our behalf, will process your data when you enter our competitions or promotional events. Your personal data will be used for BY TERRY to administer promotions, competitions and/or prize draws including, but not limited to, contacting contestants and delivering prizes.

The processing of your personal data is based on your consent when you choose to enter a competition. You have the right to withdraw your consent for the processing of your personal data at any time. When you do so, BY TERRY will not be able to provide you with the services mentioned above.
